Foreigners can legally buy condominiums in Thailand under their own name, as long as:
- The total foreign ownership in the building does not exceed 49%
- The money used to buy the property is transferred from abroad in foreign currency
However, foreigners cannot directly own land in Thailand. But there are legal alternatives:
- Leasehold – You can lease land or a house for up to 30 years, with the option to renew.
- Setting up a Thai company – Foreigners can set up a Thai company (with majority Thai ownership) to buy land.
- Buying through a Thai spouse – If legally married to a Thai citizen, property can be bought under their name with proper legal agreements.
It’s always recommended to consult a lawyer who specializes in Thai property law to ensure a safe and legal transaction.
